Please read these Terms and Conditions carefully, as they contain important information regarding your legal rights, remedies, and obligations and in using this website you are deemed to have read and agreed to the following Terms and Conditions, including the Waiver and Release:

The following terminology applies to these Terms and Conditions, Privacy Statement, Disclaimer Notice and any or all Agreements: “Client”, “Member”, “Visitor”, “You”, and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”,  “Our” “we” and “Us” refers to our Company, Rev 1 LLC (d/b/a SPIRE Fitness). “Party”, “Parties,” or “Us” refers to both the client and ourselves, either the client or ourselves as determined by the context of the sentence. All terms refer to the offer, acceptance or consideration of payment necessary to undertake the process of our assistance to the client in the most appropriate manner, for the express purpose of meeting the client’s needs in respect to the Company’s stated services and products, in accordance with and subject to prevailing Wisconsin law. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

Our website, http://www.SPIRE-fitness.com, provides users with basic information about us, as well as the ability to book, cancel, and pay for services and products offered at our facilities. The extent of services offered by us are limited to those described on our website, which is hosted in the United States.  We reserve the right to add, change, remove or modify the services provided by us as well as the policies under which we operate without notice or obligation.

Privacy Statement

We, like You are sensitive to the collection, storage and use of personal information.  Our Company is committed to protecting the privacy of our customers and clients. Our privacy policy outlines the type of information that we receive and collect when you use the features on our website as well as some of the steps that we take to safeguard this information. Please read this privacy policy before using our website or submitting your personal information. By using this site you are accepting the practices described in this privacy policy.

 

Collection of Information

We collect personally identifiable information, such as names, postal addresses, email addresses, credit card information and dates of birth when customers create personal account profiles, which are necessary to book and participate in our classes.  We use email addresses to maintain contact with you regarding your class schedules, account status and for general communication.  We may, from time to time, send email to you alerting you to special events we may host or to acknowledge activities or milestones relevant to you.  We do not, and will not, share with or sell your confidential information to third parties at any time.  As email addresses are used to identify Customers, we do require that an email address be provided at sign-up.

 

It is important for you to protect against unauthorized access to your account, password and to your computer, tablet or phone (collectively, “Devices”). If you use our website, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your devices, and you agree to accept sole responsibility for all activities that occur under your account or password, including the purchase of goods and/or services.  Please be sure to sign off when you are finished using a shared computer.  Our system does not enforce restrictions on passwords or require the changing of passwords at regular intervals.  Therefore, we highly recommend that you create and use passwords that are not easily guessed or intuited.  Using combinations of letters, numbers and symbols and avoiding the use of proper names, birthdays and the like can help protect your account’s safety.

 

Only authorized employees, representatives, agents, and contractors who have agreed to keep information secure and confidential have access to personally identifiable information.  None of these parties is allowed to use confidential information for any purpose other than for serving customers or assisting us in monitoring the performance of our business.  All emails and newsletters from this site allow you to opt out of future marketing mailings.

 

We reserve the right to refuse account creation, terminate accounts, remove or edit content or cancel orders in our sole discretion. When you visit our website or send emails to us, you are communicating with us electronically, and, therefore consent to receive communications from us electronically.  We will communicate with you by email or by posting notices on this website. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

Photograph Release

By agreeing to these terms, you authorize SPIRE Fitness to use photos, and or other likeness’ for any promotional materials regarding SPIRE Fitness programs, facilities, or services. Such likeness’ will not be sold to other parties. Promotional materials bearing these likenesses may be distributed for free to the public and posted on the SPIRE Fitness website. 

Purchases of Classes, Packages and Merchandise

Our website delineates the current class and package options available for our classes.  Pricing is subject to change without notice, and prices listed on the website shall be applicable once posted.  Classes and packages must be used within the specific time periods noted at the time of purchase.  We may extend packages via a “grace period” but are under no obligation to do so. We do not provide refunds for class packages or memberships.  Our email system is programmed to send you reminder emails in advance of a package’s expiration, but we are not responsible for any failure of reminder emails to reach you due to system malfunction, transmission errors, SPAM filters, etc.

Packages are not transferrable or shareable.  If you are bringing a guest, your guest must create an account with us and accept these Terms and Conditions.  Your account will be debited for the number of guest in attendance as well as your own class.

We sell various items of clothing and accessories at our location.  We accept returns of merchandise within 14 days of purchase for store credit or exchange.  We do not offer cash refunds.  Items returned must be unworn or unused and complete with original tags and/or packaging.  Allowances will be made for defective or damaged goods if brought to our attention with 14 days of purchase. Items purchased on sale or mark-down are not returnable.

Cancellation Policy

In order to cancel a SPIRE Fitness class, you must cancel your reservation eight hours before your scheduled class. You can cancel your reservation in the following ways:

1.    Login to our Spire Fitness Studio App and cancel your reservation
2.    Call SPIRE Fitness and have us cancel the class for you. (414) 219-9118

For classes canceled less than eight hours before your scheduled class, a late cancellation fee of $12 will be charged to your account. All no shows will be charged a fee of $22.

For riders running late: We ask that you call the studio to let us know that you are on the way. The front desk will hold your reservation. If you do not call to let us know you are on your way, in fairness to our riders, bikes will be released five minutes before class begins. However, five-minutes after the class has started you will not be allowed to enter the studio.  This is both for your safety and the enjoyment and focus of other riders. New clients must arrive 15-minutes before class begins

Waitlist Policy

If your preferred class time is completely booked, we highly recommend placing yourself on the waitlist. As spots open up, they are assigned to waitlisted clients in the order in which they registered. Please purchase a class or package before signing up on the waitlist. The class will be returned to your account for future use if you are not added into class. We do not provide refunds for SPIRE Fitness class purchases.

If a spot becomes available, you will receive notification from SPIRE Fitness via email confirming your automatic enrollment (note:  please check your SPIRE account to be sure your email address is correct). You also have the option to enroll in text message reminders. Ask the front desk for more information.

If you are no longer interested in a class for which you are on the waitlist, please remove yourself from the waitlist (online or by emailing the studio at reservations@spire-fitness.com) to avoid a late cancellation charge of $12 or losing your credit.

Walk-ins are welcome. Should any last-minute spots open up prior to the start of class, we will gladly offer them to any walk-ins. Your account will be charged upon confirmation of a spot in class.

You will be charged a $22 no show fee for holding a waitlist spot should you receive one and not show up for class.

For Riders Leaving Early

If you're planning on leaving early, we kindly request that you tell the instructor ahead of time. Please leave before the final stretch so it doesn’t disrupt class. 

Membership Freezes

If you wish to freeze or suspend your membership, you may do so for a period of no less than one month and no more than three months during the term of this Agreement. Clients must provide an advanced written notice to SPIRE Fitness at least 10 days prior to the next scheduled membership payment and prior to the start of the freeze. Client shall pay a $40.00 hold fee. Membership is defined as a multiple payment contract of three months or greater. We do not provide the option to freeze for class packages or single month options. Accounts will be frozen and access to classes will be restricted during your membership freeze.   

Participation Requirements

You must be at least 18 years of age to book a class at our facility.  For persons under the age of 18, you must receive written permission from a parent or guardian, as acknowledged in our Waiver and Release for persons under the age of 18, provided below.  For persons under 16 years of age, participation in a class will be at the sole discretion of our instructors.

For classes specifically offered to persons under the age of 16, such restrictions do not apply.

In-studio Environment

Our classes are designed to require intense physical exertion and demanding cardiovascular effort.  Participants should be aware that temperatures in the Studios may rise into the 80s despite the operation of our environmental systems.  We recommend that you bring or purchase a bottle(s) to hold water or other hydrating beverages for use in class.  We also suggest that you consult with your health care provider before undertaking our or any other forms of strenuous exercise.  If at any time in a class you experience difficulty breathing, pain or other symptoms inconsistent with strenuous exercise, STOP IMMEDIATELY and notify an instructor or staff member at once.

Our classes are set to music that may be played at high volumes.  If you are sensitive loud music, we suggest you wear foam ear protection. Some of the music played during classes may contain explicit language.  If this is a concern to you, we request that you check with your instructor prior to class to understand the nature and amount of language. 

If you must leave early, please inform your instructor before the class begins, and if possible, please choose a bike, rower or mat near the door so as to minimize any potential disturbance to others.

 SPIRE Fitness Waiver and Release of Liability

By signing up for and/or attending SPIRE Fitness classes, activities, or using our facilities and equipment, as well as reading our website, you acknowledge the inherent risks involved in activities such as indoor cycling, rowing, TRX, strength training and other exercise forms. These activities may involve injury or, in rare cases, death.

In consideration for participating in SPIRE’s Classes and using our Facilities, you agree to the following:

  1. Assume Responsibility: You take full responsibility for any injuries or damage you may sustain during participation.

  2. Release Liability: You waive and release SPIRE Fitness (Rev 1 LLC), its employees, contractors, agents, and all affiliates from any claims or damages resulting from your participation.

  3. Medical Fitness: You confirm that you are physically fit to participate in SPIRE’s activities and have no medical conditions that would put you at risk during participation.

Safety and Compliance

  • You agree to follow all safety instructions, rules, and guidelines provided by SPIRE staff.

  • If you have a chronic condition or health concern, we advise you to consult your doctor before participating. If SPIRE staff believes you're at risk, you may be asked to provide a doctor's note confirming it’s safe to participate.

Risks of Participation

Physical activities, especially those like cycling, rowing, TRX and strength training carry inherent risks. SPIRE is not liable for any injuries, damages, or issues resulting from your use of our facilities.

By participating, you release SPIRE from all liability, including any personal injury or property damage that occurs while using our facilities or taking part in our activities.

Medical Conditions Related to Lighting

Strobe Lights and Photosensitivity: SPIRE Fitness may use strobe lights or flashing lights in some of our classes, particularly in the spin studio. If you have a medical condition such as epilepsy, photosensitivity, or any other condition affected by flashing lights, please consult your doctor before attending classes that may involve this lighting. By participating in these classes, you assume full responsibility for any risk related to the lighting effects.

No Liability for Third Parties

SPIRE is not responsible for any third-party actions that may harm you or your property, including defamation, offensive conduct, or unauthorized access to personal information.

Medical Restrictions

If SPIRE determines that your health condition poses a risk during participation, you may be asked to provide a doctor’s note to proceed. Otherwise, SPIRE reserves the right to refuse participation.

Legal and Governing Law

This agreement is governed by the laws of Wisconsin. Any claims must be brought in Wisconsin courts.

Minor Participants

Before any person under the age of 18 can participate in SPIRE’s classes or use our facilities, the parent or legal guardian must provide written consent to this Waiver and Release.

By signing, you, as the parent or legal guardian of the minor participant, acknowledge, appreciate, and agree to the following:

  1. Compliance: You agree to ensure that the minor follows all safety rules, instructions, and guidelines provided by SPIRE staff during participation in any class, event, or program.

  2. Acknowledgment of Risk: You understand that physical activities have inherent risks that cannot be completely eliminated, and that some of these risks may result in injury.

  3. Release of Liability: You, on behalf of the minor, and your respective heirs, assign, and next of kin, release SPIRE Fitness (Rev 1 LLC), its staff, contractors, and agents from any and all claims or damages related to participation in SPIRE's classes and use of its facilities.

  4. Waiver of Rights: You acknowledge that by signing this waiver, you are giving up significant legal rights, including the right to sue SPIRE for any injuries or damages. You understand that this is a voluntary and unconditional release of liability to the fullest extent allowed by law.

  5. Indefinite Term: This Waiver and Release remains in effect indefinitely, unless withdrawn by the parent or legal guardian of the minor.

SPIRE’s Intellectual Property

The “SPIRE Fitness” name, logo, and all related graphics, designs, page headers, button icons, and scripts are trademarks and service marks of Rev 1 LLC, doing business as SPIRE Fitness. You may not use them for any purpose other than as allowed by these terms.

You are permitted to view, electronically copy, and print portions of this website for personal use, such as making class reservations. Any other use of the materials on this site, including reproduction or distribution, requires prior written permission from Rev 1 LLC (SPIRE Fitness). Unauthorized use is strictly prohibited.


Limitation of Liability

In no event shall Rev 1 LLC, doing business as SPIRE Fitness, its officers, directors, employees, or agents be held liable for any direct or indirect damages resulting from:

  1. Errors, mistakes, or inaccuracies in content.

  2. Personal injury or property damage related to your use of the website.

  3. Unauthorized access to personal or financial information stored on our secure servers.

  4. Interruptions in service or website access.

  5. Viruses, bugs, or other harmful software transmitted through the website.

  6. Any errors or omissions in content or loss/damage from using the content available on the website.

This limitation applies to the fullest extent allowed by law. You also acknowledge that SPIRE Fitness is not responsible for any harmful or illegal actions by users of the website, and any associated risk or damage is your responsibility.

Updates to Terms and Conditions

We reserve the right to update or revise these Terms and Conditions at any time. By using this website, you agree to be bound by any future changes. We recommend that you periodically review this page to stay informed of the latest terms.

Acknowledgment

By signing up for SPIRE Fitness, you acknowledge that you have read, understood, and agree to all the terms outlined above, including those related to the use of lighting effects in certain classes. You waive any right to hold SPIRE responsible for any injuries or damages during your participation.
